🔁 What is the DOT Return to Duty Process?
The process is governed by 49 CFR Part 40, which outlines five key steps every DOT employee must follow:
1️⃣ SAP Evaluation
A DOT-qualified Substance Abuse Professional (SAP) conducts a clinical assessment to determine the nature of the violation and recommend appropriate next steps.
2️⃣ Treatment or Education
You must complete the SAP’s recommended treatment program, which may include substance abuse education, counseling, or rehabilitation.
3️⃣ Follow-Up Evaluation
After completing treatment, you’ll meet again with the SAP to determine your readiness for return. If approved, the SAP authorizes the Return-to-Duty test.
4️⃣ Return-to-Duty Test
This is a directly observed drug or alcohol test. A negative result is required before resuming any DOT-regulated work duties.
5️⃣ Follow-Up Testing Plan
Your SAP will create a testing schedule for your employer that includes at least 6 unannounced tests over the next 12 months, potentially extending up to 5 years.
