Centre for Substance Use Research Ltd (CSUR) has advised that since 1 April 2017, any companies or individuals that want to carry out activities that involve raw tobacco in the United Kingdom must get the necessary approval from HM Revenue and Customs (HMRC).

Anyone that puts raw tobacco into a controlled activity inside the United Kingdom must get approval first, though there are exceptions. It is illegal to deal with raw tobacco until the necessary approval is granted. CSUR has experience helping clients apply for approval for ENDs companies to submit applications to PMTA, MRTP, and TDP.

The application involves a letter to apply to the scheme, which must be applied by the person responsible for the business. This can be a partner, sole proprietor, representative for group registration, or the authorised signatory of a corporate body. When the application is by a company, there must be a declaration made by the direction, in limited liability partnerships, it must be the designated member that makes the declaration, while in limited partnerships, it can be a general partner. The person submitting the declaration must declare that the information contained is true and complete.

Sophie Motley, a Research Fellow at Centre for Substance Us Research Ltd, said “It can take forty-five working days for approval to come through, which is why we recommend our clients submit at least that time before they want to start trading. Information will need to be provided regarding the raw tobacco-controlled activities the company or person will be undertaking, along with full contact information, details on the controlled activities, and the address of the premises where the activities will be carried out. It's not a fast application and it requires a lot of information before approval is granted.”
