More importantly our clients can receive a divorce without leaving their home. Court appearances are no longer required. In effect, uncontested divorces have gone online.
In practice, the client receives by email a preliminary intake form or settlement agreements that captures the information needed by the attorney to prepare all the final documents. The attorney will then return the final documents ready for notarized signature to the client within one day. Once the attorney receives these notarized documents, they are filed electronically. After a 31 day waiting period, the client will receive a motion for judgment on the pleadings, which will require signing and notarizing a one page affidavit, which is filed and forwarded to the assigned judge for signature of the final judgment and decree of divorce. Judges typically take one week to sign the decree, file its and forwarded to the clients and their attorneys.
Gone are the days when parties represented by lawyers has to appear in court for a final hearing with all the stress of traffic parking dressing up for court – all gone.
