In 2014, Colorado legalized the recreational use of marijuana. Now a new bill passed in June 2021 and will take effect from January 2022 to limit the daily quantities of concentrate purchased.

They reduced limited quantities to a fifth of what they used to be. Added to the bill was all marijuana dispensaries will have to adhere to a real-time database to ensure people don’t frequent different marijuana dispensaries to exceed the daily concentrate limit. The bill passed with little resistance and broad bilateral support. Saying, it was hugely favored by parents and physicians, people who believed the decision was an important step to regulate this industry.

The biggest factor that contributes to the new legislation, was to protect the underage youth.
Nate Balducci Marketing Director of Rocky Mountains Cannabis says, “We feel the bill to limit the daily quantity of concentrate is unconstitutional, as some underage marijuana patients require more concentrate as what the new bill`s daily limits are. We think that the measure violates the state constitution. We a client with acute epilepsy who says that the measure would jeopardize his ability to access medicinal-necessary concentrate.”Balducci argues that the bill violates the protection of medical marijuana patients and their right to privacy.

The state of Colorado states that systems will be in place, which will not contain names, dates, and any other form of personal information. The system will only run on a person’s unique identity documentation. Lawmakers also state that they are concerned about data tracking related to marijuana concentrate sales.
The question raised here is, how will this system and the new bill be controlled? Currently, the suggestion on the table is through identity documents. Underage kids have testified how easily these medical cards are available, and how easy it is for them to purchase these fraudulent medical cards on the black market. Through easy access to fraudulent medical cards on the black market, the lives of many youths and their family are destroyed. Not only do these illegal actions ruin the lives of families but the lives of medical concentrate patients as well.

“What measures will be in place to stop fraudulent medical cards? The focus should not reduce daily doses on concentrate, as that is not the problem Colorado is facing. The problem here is the illegal substance abuse amongst the youth while legal dispensaries remain within the age restriction for their clients. It is as if lawmakers want to punish the law-abiding to get to the criminals,” Balducci concludes.
