Patrick Andrew Fleming of Chicago's Novack and Macey Win "Every Penny"

Patrick Andrew Fleming won partial summary judgment for their client, Apex Construction Company, a local construction contractor, in the Circuit Court of Cook County, Illinois.
 
Patrick Andrew Fleming, lead counsel of Chicago's Novack and Macey, along with Julie Johnston-Ahlen and Richard G. Douglass, won partial summary judgment for their client, Apex Construction Company, a local construction contractor, in the Circuit Court of Cook County, Illinois.

After the prime contractor of a public construction project failed to pay Apex for the work it had done, Novack and Macey filed a complaint on the contractor’s behalf against both the prime contractor and the bonding company that issued the project bond required under Illinois law. Novack and Macey filed a motion for partial summary judgment, seeking recovery from the bonding company of the amounts owed under the project bond. Both the prime contractor and the bonding company opposed the motion. Nonetheless, the Court granted the motion and Novack and Macey won a judgment for every penny that its client was seeking. Thus, the Court entered judgment in favor of Apex in the full amount that it was seeking, plus prejudgment interest and attorneys’ fees under the terms of the bond.
