If you’re a commercial driver or employee in a DOT-regulated role and you fail a drug or alcohol test, you may wonder, “What happens next?”
The consequences are serious—but they don’t mean the end of your career.
At AACS Counseling, we help individuals regain their eligibility to return to safety-sensitive duties through the DOT Return-to-Duty Process, guided by qualified Substance Abuse Professionals (SAPs).
🚫 What Happens Immediately After Failing a DOT Test?
If you test positive for drugs or alcohol under 49 CFR Part 40, the following occurs:
Immediate Removal from Duty
You cannot continue working in any DOT-regulated safety-sensitive position (such as truck driving, aviation, pipeline, or transit jobs).
Referral to a DOT-Qualified SAP
You must be evaluated by a certified Substance Abuse Professional who will assess your situation and recommend a treatment or education plan.
Complete the SAP Program
This includes:
An initial clinical evaluation
Completion of treatment or education
A follow-up SAP evaluation
A Return-to-Duty test (must test negative)
A Follow-Up Testing Plan provided to your employer
Ongoing Testing
You’ll undergo at least 6 unannounced follow-up tests in the first 12 months after returning to work—potentially up to 5 years, as required by the SAP.
“Failing a DOT test is a wake-up call, but it’s also a chance for a fresh start,” says a licensed SAP with AACS Counseling.
“We support our clients from evaluation to reinstatement—with empathy, speed, and full legal compliance.”
